What the Clearinghouse requires of employers

The rules are specific, and the penalties for missing them are assessed per violation. These are the obligations we take off your plate.

  • Register your company in the Clearinghouse and designate a C/TPA if you are an owner-operator
  • Run a full query before a CDL driver performs safety-sensitive functions
  • Run a limited query at least once every 12 months for each current driver
  • Report refusals, positives, and actual-knowledge violations within the required window
  • Retain query and consent records for three years

What is the FMCSA Drug and Alcohol Clearinghouse?
It is the federal database that records drug and alcohol program violations for CDL and CLP drivers. Employers must query it before hiring a driver and at least once a year for every current driver, and must report violations to it.
Do I need a C/TPA to use the Clearinghouse?
Owner-operators are required to designate a C/TPA. Other employers are not required to, but most use one so queries, reporting, and recordkeeping are handled correctly and on time. 365 EasyScreen is a registered C/TPA.
What is the difference between a limited and a full query?
A limited query tells you whether information exists on a driver and requires the driver's general consent. A full query returns the actual records and requires the driver's electronic consent in the Clearinghouse. Pre-employment queries must be full queries.
How often do I have to run annual queries?
At least once every 12 months for each CDL driver you employ. Missing an annual query is one of the most common findings in a DOT audit.
What happens if a driver has a violation?
The driver is prohibited from performing safety-sensitive functions until they complete the return-to-duty process with a Substance Abuse Professional and a negative return-to-duty test. We help you document each step.
